These Terms of Use (“Terms”) govern access to and use of TradingNext, including tradingnext.net, app.tradingnext.net, related software, APIs, tools, strategy builders, automation functions, signals, calculators and other services (collectively, the “Services”).

By creating an account or using the Services, you agree to these Terms.

1.1 What TradingNext is

TradingNext is a software and technology platform that enables users to create, configure, test and automate their own trading strategies through accounts held with independent third-party brokers and exchanges.

TradingNext is not a broker, exchange, custodian, bank, portfolio manager or investment adviser. TradingNext does not accept trading deposits, custody client funds or assets, process withdrawals from users’ broker/exchange accounts, or exercise discretionary control over users’ accounts.

Users select their own platforms, accounts, strategies, instruments, parameters, position or trade sizes, risk settings and automation settings, and retain control over activation, suspension and termination of automated strategies.

1.2 Eligibility

You must be at least 18 years old, have legal capacity to enter into a contract, and be legally permitted to use the Services and the relevant third-party broker/exchange services in your jurisdiction.

You may connect only accounts that you own or are lawfully authorised to operate.

1.3 User control and automation

TradingNext automates user-defined instructions and strategy rules. Where a user activates an automated strategy, the software may submit instructions through an authorised connection to the selected third-party platform.

The user remains responsible for choosing the broker or exchange, strategy, markets/instruments, parameters, position or trade sizing, risk controls, and for activating, pausing and stopping automation.

TradingNext does not have authority to withdraw funds from connected accounts. Withdrawal functionality is unsupported by design.

Unless the user has explicitly enabled a supported flexible-selection feature, the platform must not intentionally substitute a different market, instrument, product or account for the one authorised by the user. If an authorised instruction cannot be executed within the configured rules, it may be skipped, rejected or fail.

1.4 Third-party brokers and exchanges

Broker and exchange accounts are provided by independent third parties. Their terms, eligibility rules, prices, payouts, market availability, execution, slippage, fees, outages, APIs and settlement processes are outside TradingNext’s control.

A connection shown as “connected” does not constitute an endorsement, guarantee or representation that the third party is suitable or legally available in every jurisdiction.

TradingNext may suspend or remove an integration if required by law, third-party rules, security considerations, API changes or technical limitations.

1.5 No personalised investment advice or discretionary management

Information, tools, strategy templates, backtests, signals, educational materials, AI-assisted conversion and automation features are provided as software functionality and general information.

TradingNext does not provide personalised investment recommendations based on a user’s personal financial circumstances and does not make discretionary portfolio-management decisions for users.

A strategy, signal, template or automated rule made available through TradingNext is not a promise that it is appropriate for a particular user or will be profitable.

1.6 Strategy conversion and AI-assisted features

TradingNext may use automated or AI-assisted systems to interpret, convert, explain, test or generate strategy logic.

Converted or generated logic may contain errors, omissions, incompatibilities or differences from the source material. Users must review the resulting configuration before using it with real funds.

Where TradingNext cannot establish a safe and supported conversion, the platform may reject the conversion or mark it for review rather than invent missing trading logic.

1.7 Risk

Trading, leveraged products, derivatives, crypto-assets, foreign exchange and similar markets can result in substantial or total loss of the capital committed. Some products may be prohibited or restricted in certain jurisdictions.

Past results, simulated results, backtests, hypothetical results and demonstrations do not guarantee future performance.

The separate Risk Disclosure forms part of these Terms.

1.8 No guarantees of execution or availability

TradingNext does not guarantee uninterrupted availability, acceptance of an instruction by a third party, a particular price/payout/fill/latency/settlement result, uninterrupted API availability, or profitability.

Connectivity, market conditions, provider outages, rate limits, latency and other external conditions may affect automation.

1.9 Security and connected-account credentials

You are responsible for protecting your TradingNext account and maintaining secure access to your email, devices and third-party accounts.

Where a broker/exchange supports scoped API permissions, TradingNext should request only permissions reasonably required for supported read and trading functions. TradingNext does not require or support withdrawal permissions and may reject credentials that include withdrawal capability.

Secrets and tokens must not be shared through public support channels.

1.10 Audit and technical records

To operate the Services, protect users, diagnose incidents, prevent duplicate operations, investigate disputes, demonstrate user instructions and defend legal claims, TradingNext may create and retain technical audit records.

These records may include account/session identifiers, user activation/pause/stop events, strategy/configuration versions and hashes, authorised market/instrument/direction/size/expiry parameters, preflight results, request/correlation identifiers, third-party order identifiers and responses, timestamps, settlement/result information, and security/administrative events.

TradingNext does not intentionally include raw passwords, private API secrets or withdrawal credentials in audit logs.

1.11 User responsibilities

You agree not to use the Services unlawfully; connect an account you are not authorised to use; circumvent jurisdiction, eligibility or provider restrictions; manipulate or attack the Services; provide false security/eligibility information; use the Services to manage third-party funds without required permissions; attempt to enable withdrawal functionality; or interfere with safeguards, risk controls or duplicate-prevention mechanisms.

1.12 Jurisdictions and feature availability

Certain Services or features may be unavailable or restricted in particular jurisdictions where required by applicable law, regulatory requirements, technical constraints or third-party platform rules.

Users are responsible for ensuring that their use of the Services and of any connected third-party platform is permitted in their jurisdiction.

TradingNext may implement jurisdiction- or account-specific restrictions without making the entire website unavailable.

1.13 Affiliate relationships

TradingNext may receive compensation from certain third-party brokers, exchanges or service providers when users register, deposit, trade or otherwise qualify through TradingNext referral arrangements, where permitted.

Such commercial relationships do not give TradingNext custody of the user’s funds and must not alter the user’s selected strategy, risk parameters or execution instructions.

1.14 Fees and paid plans

Some Services may be free, affiliate-supported, trial-based or paid. Paid functionality, when activated, will be presented with applicable price, billing period, renewal and cancellation information before purchase.

Subscription fees, if any, are payments for software access and are separate from funds held at brokers/exchanges.

1.15 Beta and experimental functionality

Some features may be labelled beta, preview, experimental, validation or test functionality. Such features may be incomplete, changed, suspended or withdrawn and may carry additional operational risk.

1.16 Intellectual property

TradingNext and its original software, interfaces, branding, documentation and platform materials are protected by applicable intellectual-property laws.

Users retain rights in strategy source code and materials they lawfully upload, subject to the limited licence necessary for TradingNext to process, store, convert, test and run them at the user’s request.

1.17 Privacy

Personal data is processed as described in the Privacy Policy and Cookie Policy.

1.18 Suspension and termination

TradingNext may suspend or terminate access where reasonably necessary for security, abuse prevention, non-payment, legal compliance, violation of these Terms, provider restrictions or protection of users and the Services.

Users may stop bots, disconnect integrations and close their TradingNext account subject to applicable retention requirements.

1.19 Disclaimers

To the maximum extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis. Nothing in these Terms excludes rights or liabilities that cannot legally be excluded.

TradingNext does not warrant profitability, uninterrupted third-party connectivity or the accuracy of market information supplied by third parties.

1.20 Limitation of liability

To the maximum extent permitted by applicable law, TradingNext is not liable for losses caused solely by market movements, third-party platform decisions, user-selected strategy parameters, unsupported use, or events outside TradingNext’s reasonable control.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including liability for fraud, wilful misconduct or other non-excludable liability.

Any final monetary cap and consumer-law wording must be completed after the legal operator and governing jurisdiction are chosen.

1.21 Changes

We may update these Terms to reflect product, legal, security or operational changes. Material changes will be communicated by reasonable means. The current version and effective date will remain available on the website.
